The West Virginia herdshare bill (SB 30) passed the Senate in February and House of Delegates in March. SB 30 was conveyed to the Governor on March 23, 2015.

Herdshares were outlawed through regulation, not legislation, by the state department of health; the department also prohibited the sale of raw milk even as pet food. It's also illegal simply to "offer" raw milk for free. If the governor neither signs nor vetoes the bill, it will pass into law 15 days after the legislative session ends.

I urge you to sign the Herdshare Bill [SB 30], to restore property rights in West Virginia and allow the co-ownership of dairy animals. It is legal throughout the United States to consume raw dairy products. West Virginians should have the right to obtain milk from animals they partially or fully own. SB 30 prohibits the sale of raw milk obtained through a herdshare arrangement.

Add your own comments and follow up with phone calls to the West Virginia Governor's office. Your message will also be sent to a local newspaper editor unless deselected.

TALKING POINTS:
  • It's a freedom of choice issue; the consumption of raw milk is legal but state residents have no legal way to exercise this right unless they own dairy animals and board them on their own property; sales of raw milk, distribution through herdshares, and currently even giving away raw milk is illegal in West Virginia.
  • Allowing herdshares will boost the rural economy and increase farmers' incomes; raw milk can be the gateway to sales of other farm products such as meat, poultry, eggs and produce.
  • The state is losing revenue to surrounding states like Ohio and Pennsylvania where West Virginians go to obtain raw milk.
